"We've been building Lost Mayhem boards here every day for almost 40 years now."
Head shaper Matt Biolos says his company's products and accessories 6cater to surfers, skaters and snowboarders—which is why he's suing Lady Gaga for 7trademark infringement.
Mayhem is the name of the superstar's latest album and concert tour. Gaga's Mayhem logo is on merchandise like T-shirts and hoodies. It's here on the left with obvious similarities to Lost Surfboards, trademarked Mayhem logo.
"Surfers, skaters and snowboarders—they don't want to be associated with so much corporate pop culture. So if all these little Gaga people are running around wearing a Mayhem shirt, my name on it, in 8mainstream life, it makes our stuff not as cool, not as 9renegade."
Before filing the suit, Biolos says he and his lawyer 10reached out to representatives of Lady Gaga.
"And they just kind of laughed at us and said, 'You're nobody. You don't have any rights.' And we were like, 'We feel that we do.' They wouldn't talk to us."
Los Angeles attorney Lou Shapiro, who is not connected to the case, says the court has a few 11factors to look at.
"Is there so similarity between the logos, which, yes, there's definitely very similar here. So the next thing the court looks at is, is there a 12likelihood of confusion? Will a consumer accidentally buy a Lady Gaga's product when they're really trying to buy this other beach stores product? That's going to be an important factor."
Biolos hopes the lawsuit against Lady Gaga will prevent her from 13diluting the reputation of his 14alternative brand.
"We don't want her money. We want her to stop. We want her to not make any merch with our name on it. We're happy to be a small brand that 15thrives and 16cruises in the underground."

샌 클레멘테에 위치한 ‘로스트 서핑보드 바이 메이헴’은 틈새 시장을 겨냥한 브랜드라는 자부심을 갖고 있습니다.
“저희는 거의 40년 동안 매일 이곳에서 로스트 메이헴 보드를 제작해 왔습니다.”
헤드 셰이퍼 매트 비올로스는 자사 제품과 액세서리가 서퍼, 스케이터, 스노보더를 위한 것이기 때문에, 상표권 침해를 이유로 레이디 가가를 고소하게 되었다고 말했습니다.
‘메이헴(Mayhem)’은 이 슈퍼스타의 최신 앨범이자 콘서트 투어의 이름입니다. 가가의 ‘Mayhem’ 로고는 티셔츠와 후드티 같은 굿즈에 사용되고 있으며, 이 로고(왼쪽)는 로스트 서핑보드의 등록 상표인 ‘Mayhem’ 로고와 뚜렷한 유사성을 보입니다..
“서퍼, 스케이터, 스노보더들은 지나치게 상업적인 대중문화와 연관되기를 원하지 않습니다. 그런데 가가 팬들이 제 이름이 적힌 ‘메이헴(Mayhem)’ 셔츠를 입고 일반 대중 속을 돌아다니게 되면, 저희 브랜드는 더 이상 멋있거나 반체제적인 이미지로 비쳐지지 않게 됩니다.”
소송을 제기하기에 앞서, 비올로스는 변호사와 함께 레이디 가가 측 관계자에게 먼저 연락을 취했다고 밝혔습니다.
“그들은 우리를 비웃으며 ‘당신들은 아무것도 아니고, 아무런 권리도 없다’고 말했습니다. ‘우리는 권리가 있다고 생각한다’고 했지만, 그들은 끝내 대화조차 하려 하지 않았습니다.”
이 사건과 직접적인 관련은 없는 로스앤젤레스의 변호사 루 샤피로는, 법원이 고려해야 할 몇 가지 요소들이 있다고 설명합니다.

비올로스는 레이디 가가를 상대로 한 이번 소송을 통해, 자신이 만든 독립 브랜드의 정체성이 흐려지지 않기를 바라고 있습니다.
“저희는 그녀의 돈을 원하는 것이 아니라 그녀가 중단하기를 원합니다. 우리 이름이 들어간 상품을 만들지 않았으면 좋겠어요. 저희는 언더그라운드에서 번창하고 성장하는 작은 브랜드로 남는 것이 행복합니다.”
